Copyright basis (EU)
Directive (EU) 2019/790 (the "DSM Directive"), Article 15, grants press
publishers rights over reproduction of press publications by online
services, but explicitly excludes hyperlinking and the use of individual
words or "very short extracts" (Art. 15(1), 15(3)). Per the Court of Justice
of the EU (Svensson, C-466/12; GS Media, C-160/15),
hyperlinking to content a rightsholder has made freely and lawfully
available online does not itself constitute a "communication to the
public" requiring separate authorisation. Article 15(3) also preserves the
existing quotation and other exceptions under Directive 2001/29/EC.
